Terms of Service

Last updated: [DATE]

This store (https://aussiecadetedwards.com) is run by AussieCadetEdwards — "we" or "us" below — through Fourthwall. These terms are a legal agreement between you and us covering your use of the store.

By using the store or buying anything from it, you're agreeing to these terms and to our Privacy Policy. If you don't agree, please don't use the store.

1. What this store is

A website where you can buy merch we make available, including physical products, digital products and memberships. We call all of it "Products".

2. Who can use it

You need to be at least 13. By using the store you're confirming that you're 13 or over, that we haven't previously removed or suspended you, and that you're using the store lawfully. If you're signing up on behalf of a company or organisation, you're confirming you have the authority to agree to these terms for them.

3. Accounts

You'll need an account to access a membership. Give us accurate information and keep it up to date. Keep your password to yourself — you're responsible for what happens under your account. If you think your account has been compromised, email us straight away at [contact@support.aussiecadetedwards.com](mailto:contact@support.aussiecadetedwards.com).

4. Payment

Prices. We set the prices. We do our best to keep the site accurate, so check current pricing on the product page. If we change a price, we'll tell you before the change applies to you. We sometimes run promotions — unless a promotion was offered to you, it doesn't change your deal.

Charging you. You're authorising us and our payment processors to charge your chosen payment method for what you buy, including tax. If you pay by card, we may pre-authorise it to check the card is valid and has funds available.

Memberships. Memberships renew automatically. Your billing date is the date you first subscribe, and you'll be charged on that date each period until you cancel. Cancel before your renewal date or you'll be charged for the next period. You can cancel any time under the Billing tab in your profile, or by emailing [contact@support.aussiecadetedwards.com](mailto:contact@support.aussiecadetedwards.com).

Returns and refunds. We'll accept returns of faulty Products within 30 days of purchase, refund you in full, and cover return postage where it's needed. We don't accept returns or give refunds on Products that aren't faulty. Full detail is on our returns page.

5. Shipping

Products ship to the address you give us, on the terms shown when you buy. Shipping costs are yours and are shown at checkout.

6. What you can and can't do with the site

Your licence. As long as you're following these terms, you may use the store and any membership you've paid for, for your own personal, non-commercial use. That licence is limited, non-exclusive, can't be transferred or sub-licensed, and we can revoke it.

What you can't do. You may not copy, distribute, publicly display or perform the site, modify it, or get around any of its security or access controls.

Feedback. If you send us suggestions or ideas about the store or our Products, we can use them freely, for anything, forever, without owing you anything.

7. Who owns what

We own and run this store. The design, graphics, layout, code, software and everything else that makes up the store and our Products (the "Materials") are protected by intellectual property law and belong to us or the people who licensed them to us. Don't use them unless we've said you can. Any rights we haven't clearly given you here, we keep.

8. Things you agree not to do

  • Break the law, anywhere
  • Infringe anyone's rights, including intellectual property — or encourage anyone else to
  • Interfere with the site's security, including disabling copy protection or reverse-engineering any part of it, except where the law specifically allows it
  • Disrupt the site or other people's use of it — no viruses, malware, spam, scraping other people's personal details, or attacking the servers and networks behind it
  • Commit fraud: impersonating someone, faking an affiliation, getting into someone else's account, or lying about your age
  • Sell or hand off your access, or any of the Materials, to someone else
  • Attempt any of the above, or help anyone else do it

9. Changes to these terms

We can change these terms going forward at any time, and we'll post the updated version here. If you keep using the store after a change, that's your acceptance of it.

We can also suspend or close your account, or end these terms, at any time. You can close your account any time by emailing [contact@support.aussiecadetedwards.com](mailto:contact@support.aussiecadetedwards.com).

10. What happens when it ends

If these terms end, for any reason: your licence stops and you must stop using the store; you lose access to your account; you still owe us anything unpaid from before; and the sections on ownership, disclaimers, indemnity and the general terms below continue to apply.

11. Changes to the store

We can change, limit or shut down the store or any of its features at any time, with or without notice, and we're not liable to you for doing so.

12. Indemnity

To the fullest extent the law allows, you're responsible for how you use this store. If a third party brings a claim against us because of it, you'll defend us and cover the resulting costs — including reasonable legal fees. This covers claims arising from: misusing the store; breaching these terms or any law; infringing someone else's rights; or a dispute between you and someone else. "Us" here includes AussieCadetEdwards and its people, and Fourthwall.

We can choose to take over the defence of any such claim at our own expense, and if we do, you agree to co-operate.

13. Disclaimers

The store and everything on it is provided "as is" and "as available". We make no warranties about it of any kind, express or implied — including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, and any warranty arising from course of dealing or trade usage.

Nothing you're told by us or anyone else, verbally or in writing, creates a warranty that isn't written into these terms. You use the store at your own risk. We're not responsible for damage to your device, loss of data, or anything that happens between you and another user.

We provide this store through Fourthwall, but these terms and any purchase you make are between you and us alone. Fourthwall is not a party to these terms and has no liability under them, for any loss you suffer using the store, or for any Product you buy.

These limits apply even if a remedy in these terms fails its essential purpose.

Some countries and states don't allow certain warranties to be excluded — where that's the case, the exclusions above apply only as far as the law permits, and nothing here removes rights you have under consumer law that can't be excluded.

14. General

The whole agreement. These terms and the Privacy Policy are the entire agreement between you and us about the store. You can't transfer them to anyone else without our written consent; we can transfer them without notice. If we don't enforce something straight away, we haven't given up the right to enforce it later. Headings are there for convenience only. "Including" always means "including but not limited to". If any part of these terms turns out to be unenforceable, the rest still stands.

Governing law. These terms are governed by the laws of [JURISDICTION], and you and we agree that any court proceeding will be brought in the courts of [JURISDICTION].

Privacy. Read our Privacy Policy — it covers how we collect, use, store and share your personal information, and it forms part of these terms.

Other terms. Any additional rules, policies or guidelines we post on the store also form part of these terms.

Electronic communications. By using the store you agree to receive communications from us electronically, and that these satisfy any legal requirement for something to be given to you in writing. Our Privacy Policy has the detail.

Contact. This store is run by AussieCadetEdwards. Email us at [contact@support.aussiecadetedwards.com](mailto:contact@support.aussiecadetedwards.com).

Support. We're not obliged to provide support. Where we do offer it, it follows whatever policies we've published.

California residents. Under California Civil Code section 1789.3, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 N. Market Blvd., Suite S-202, Sacramento, CA 95834, or on (800) 952-5210.
